To sell a specific physical portion, identify it properly and check whether subdivision is allowed. Selling an undivided share differs: the buyer becomes a co-owner, not automatically owner of a marked corner.
Practical example
A seller promises 300 square metres out of 1,000. A hand-drawn boundary does not create a separate cadastral unit.
What to do
Prepare a survey and check subdivision, access, servitudes and mortgages in advance. Set out the sequence of creating and selling the new unit. Assess participation of an encumbrance holder where needed.
