Documents and the situation on the ground matter. Where the exact boundary cannot be established, the Code considers actual possession and then other criteria. Equal division of the disputed strip is not automatic in every case.

Practical example

The same strip appears in two old plans. Unilaterally drawing a new cadastral line will not resolve the issue.

What to do

Obtain both plots’ title documents and archive plans. Identify the disputed section by survey and propose a written agreement. Without agreement, a court may assess the boundary and appropriate protection on the evidence.
