First establish the actual boundary and ownership basis. Compare the cadastral plan with an on-site survey and the neighbour’s records. Another person’s possession or fence may justify recovery or removal of interference.
Practical example
A fence has stood in the same place for years, but a new survey differs. A new survey alone will not always settle a historical title dispute.
What to do
Prepare old plans, extracts and a professional survey and notify the neighbour in writing. Rather than demolishing the fence yourself, consider an agreed boundary or court; encroachment during construction also has special conditions.
