Necessary access may be considered if a plot lacks the connection to a public road required for proper use. This is not simply a right to choose the shortest or most convenient route. Necessity and the burdened neighbour’s interests matter.
Practical example
Existing access is difficult but usable. Wanting a shorter route through the neighbour’s courtyard does not itself prove necessity.
What to do
Prepare an access plan and alternatives. Agree the route, width, type of use and compensation. The law excludes the duty to tolerate access where the owner arbitrarily removed an existing connection.
