The Code excludes a limitation period for a claim to terminate the shared right. Passing years alone do not bar division. Ownership, share sizes and limitation periods for related monetary claims still need separate checking.

Practical example

Co-owners have occupied separate rooms for ten years. This may evidence a use arrangement, not necessarily a completed legal division.

What to do

Obtain current and historical extracts, plans and agreements. Identify whether the claim concerns use or termination of shared ownership. Do not automatically apply the no-limitation rule to expenses or past income.
