Title documents and special homeowners’ association legislation determine status. A roof not individually owned is common property. Living on the top floor does not itself confer exclusive rights to the entire roof.
Practical example
A top-floor owner uses the roof as a terrace. Check an individual right or proper joint-owner decision and whether technical access is restricted.
What to do
Obtain the building plan, registry documents and association minutes. Use, disposal and construction are separate matters. Independently check technical safety and permit requirements for any alteration.
