Prove damage, unlawful conduct by the responsible person, fault where relevant and causation. The amount must relate to actual damage and restoration. Being upstairs does not automatically make an occupant liable for every leak.
Practical example
A carelessly connected washing-machine hose damages the apartment below. Establish who used it, how the failure occurred and what was directly damaged.
What to do
Keep the technical report, photographs, evidence of prior condition and receipts. Send a quantified claim to the correct person. A demand for a complete expensive renovation must correspond to the damage actually caused.
