Delegation depends on the document, mandate and statutory conditions. An agent cannot simply grant broader powers than they received. The delegated document must be checked against the original.
Practical example
The original agent cannot receive money. Granting that power to a substitute cannot bypass the restriction.
What to do
Expressly permit or prohibit delegation and define its scope. Check both documents’ term, form and termination. Address selection and supervision responsibility; provide the complete chain to the counterparty.
