Short answer

Generally, an agent cannot transact with themselves unless authorised by consent or an applicable statutory exception. Broad disposal wording is not always a safe confirmation of self-dealing permission.

Practical example

An agent instructed to sell names themselves as buyer. Establish whether proper consent existed and on what terms.

What to do

Expressly allow or prohibit self-dealing. Specify price, payment evidence and restrictions. Consent does not prevent separate assessment of deception, excess of authority or other breaches.

Legal basis

Georgian Civil Code — Articles 114, 103, 104. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
