Short answer
Once the surety satisfies the creditor, the claim against the main debtor passes to the surety. Its scope, payment and available debtor defences must be established. Not every payment guarantees full reimbursement.
Practical example
A surety pays part of a bank debt and seeks recovery. Evidence of payment and the transferred claim’s extent is needed.
What to do
Obtain the creditor’s receipt, balance statement and payment documents. Notify the debtor and demand reimbursement in writing. Agree any schedule with existing security and limitation periods in mind.
Legal basis
Georgian Civil Code — Articles 905. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
