Short answer
A demand must stay within the suretyship cap and terms. An ordinary surety may have a defence requiring attempted enforcement against the main debtor first; joint and several suretyship has different statutory conditions.
Practical example
Principal debt is GEL 30,000 but the surety cap is GEL 10,000. The debt’s size alone does not make the surety liable for GEL 30,000.
What to do
Check the cap, joint-liability wording, warning and default. Compare interest and penalties separately with the agreement. Raise applicable defences and payments in your response.
Legal basis
Georgian Civil Code — Articles 894, 895, 898, 899. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
