One co-owner’s occupation does not automatically create liability for market rent. Consent, access to use, obstruction and the claim’s basis matter. Sharing rental income differs from compensation for personal occupation.
Practical example
One owner has moved away but remains free to use the apartment. That differs from changed locks and unsuccessful requests for access.
What to do
Document requests for use, refusals and agreements. Collect income evidence if the apartment is rented. The basis, period and amount of compensation need individual justification.
