Short answer
Money received while carrying out an assignment does not automatically become the agent’s personal income. The principal may require an account and transfer of what was received in connection with the assignment. Agreed expenses and remuneration must also be established.
Practical example
A representative sells an apartment and receives the price. Payment into their account does not itself entitle them to keep it.
What to do
Retain the power of attorney, mandate agreement, sale contract and transfer records. Request an account, substantiated expenses and the remaining funds in writing.
Points to consider
If authority extended only to signing, authority to receive the price must be assessed separately.
