Rental primarily grants use of an item. A lease also enables receipt of fruits or income from proper management. The contract’s name is not decisive: its property and actual terms matter.
Practical example
Renting an empty office may differ from receiving an equipped farm with the right to its produce. Calling both arrangements a lease does not settle their legal classification.
What to do
Describe the property, purpose and income rights. Specify inventory, upkeep, risks and return. Correct classification affects termination periods and costs.
