Equal use of a boundary fence is presumed unless its appearance clearly indicates ownership by one neighbour. This does not definitively determine the location or title to every section without examining documents.

Practical example

Both neighbours use a fence. One wants it removed, while the other has an interest in keeping it; the Code specifically addresses this.

What to do

Check the boundary, construction agreement and cost history. Agree maintenance, height and changes in writing. Consider shared-use maintenance and unilateral-alteration rules, and check building requirements separately.
