The Code provides a relevant right concerning encroaching branches and roots, but its exercise must comply with other mandatory rules. Entering beyond your boundary or damaging the whole tree should not be treated as the same right.

Practical example

A branch touches the roof. First establish the boundary and necessary work; removing it differs from cutting down the entire tree in the neighbour’s garden.

What to do

Notify the neighbour and photograph the problem. Use a specialist where necessary and check local tree-protection rules. Keep action within necessary limits; unlawful damage may create liability.
