Conditions differ for movable and immovable property. Years of residence alone are insufficient: for immovable property, the Code addresses a person registered as owner for fifteen years and possessing it as their own throughout that period.

Practical example

A tenant has lived there and paid rent for twenty years. This is not equivalent to fifteen years of registered possession as an owner.

What to do

Examine the full registry history and basis of possession. Distinguish acquisitive prescription from special procedures recognising land ownership. Calculate the period separately; neighbours’ statements alone do not establish every requirement.
