A later sale complicates recovery. Claims between donor, recipient and new buyer must be distinguished. Protection of registered rights and a good-faith buyer means a challenge to the gift does not always allow recovery from the new owner.

Practical example

The recipient sold after the donor’s objection. The buyer’s knowledge of the dispute and ownership problem matters, not merely the transfer date.

How to prepare

Obtain current and historical extracts and retain pre-sale notices. Discuss the correct respondent and procedural measures addressing further disposal during the dispute with a lawyer.
