Changing your mind after a gift is not enough to recover an apartment. Possible grounds include serious insult or gross ingratitude by the recipient, failure to fulfil an agreed condition, or financial hardship meeting statutory requirements. Each ground has different conditions; a letter to the Public Registry does not automatically change ownership.
Practical example
A simple disagreement between parent and child does not itself amount to gross ingratitude. A court assesses the conduct, its seriousness and the evidence.
How to prepare
Prepare the gift agreement, a current registry extract and supporting evidence. For ingratitude, when the donor learned of the relevant circumstances matters: the law sets a one-year period.
