Recovery may be considered if the donor can no longer support themselves or their dependants after the gift. The property must still exist, and returning it must not cause the recipient hardship. An exception applies where the donor caused their hardship intentionally or through gross negligence.

Practical example

When treatment costs rise and income is lost, a low-pension certificate alone is insufficient: essential family expenses must also be assessed.

How to prepare

Collect income, health and essential-expense records and examine the recipient’s position. If the gift deprived the donor of support from the outset, the prohibition on such a gift requires separate assessment.
