Ownership can be transferred while reserving a separate right of use for the donor. Relying only on a family promise is risky: the agreement should define the type, scope, duration and registration of the right. A personal servitude differs from usufruct.

Practical example

A parent gifts an apartment to a child but wants lifelong use of particular rooms and shared spaces. The arrangement should also be properly documented with a future buyer in mind.

How to prepare

Specify who may live there, utility payments and whether letting is allowed. Check mortgages and priority of rights: a right of use does not remove every risk.
