For immovable property, registration, good faith and knowledge of disputes matter alongside contract dates. Rules for double sales of movables cannot simply be applied. One buyer may have a property right and another a monetary claim against the seller.

Practical example

The first buyer paid in advance; the second registered ownership. The first payment alone does not determine the outcome.

What to check

Obtain the registry history and all agreements and preserve evidence of the second buyer’s knowledge. Promptly assess interim measures and repayment options. Signs of fraud do not automatically replace civil remedies.
