Establish which deadline is breached: construction, commissioning-related steps, registration or keys. Contractual penalties, performance and damages are different issues. Withdrawal may require an additional period for performance.
Practical example
Construction is finished, but agreed utilities do not work. Offering the keys may not amount to proper handover.
What to do
Send a written demand citing the relevant clause. Retain payments, handover notices and proven expenses. Examine the cause and any exemption clause separately; not every delay attracts the same liability.
