Short answer

Writing is mandatory where required by law or the parties’ agreement. Signature certification, notarisation or registration may additionally be needed. A simple written text does not satisfy all these requirements.

Practical example

The parties agree that their contract takes effect only on signing. Subsequent oral consent may fail their own form requirement.

What to do

Check the transaction and special rules. Identify parties, subject, price, term and signatures. Exchanging letters may sometimes suffice, but does not automatically replace mandatory notarisation or registration.

Legal basis

Georgian Civil Code — Articles 59, 68, 69, 328. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
