Proof of performance reduces the risk of repeated claims. Ask the creditor for a receipt and return of the debt instrument as applicable. Undocumented cash payment is particularly risky.
Practical example
The last instalment is paid in cash but the creditor retains the old acknowledgment. Further evidence may be needed in a later dispute.
What to do
State the contract, amount, date and balance in the receipt. Expressly address principal, interest and other agreed sums. Request release of security separately and verify registry records.
