Short answer

Oral loans are permitted, but their validity cannot be established solely through witness testimony. The duty to repay must be proved as well as payment. Freedom of form does not remove evidential requirements.

Practical example

A transfer is accompanied by messages acknowledging a loan and repayment date. That evidence differs from having only witnesses to payment.

What to do

Collect bank statements, correspondence, acknowledgments and partial repayments. Preserve context. Check the deadline, purpose and limitation period; a subsequent written agreement may reduce the dispute.

Legal basis

Georgian Civil Code — Articles 623, 624, 626. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
