Short answer
Paying another person’s obligation and recovering that payment are separate issues. The basis may be agreement, suretyship, transfer of a claim or another relationship. Payment does not automatically create a new loan.
Practical example
Someone pays a friend’s bank debt without agreeing whether it is assistance or repayable. Recovery needs evidence of both payment and the relationship’s basis.
What to do
Document instructions, amount and reimbursement before paying. Check the creditor’s acceptance requirements. If acting as surety or protecting property, preserve documents supporting any transferred claim.
Legal basis
Georgian Civil Code — Articles 371, 372, 905. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
