Short answer

Spouses may divide joint property while still married. Division does not itself end the marriage. The status of undivided and future property needs separate treatment.

Practical example

The spouses allocate their apartment and land but remain married. Property bought the following year does not automatically become separate because of that earlier division.

What to do

Distinguish an agreement dividing specified assets from a marital agreement governing future property. Prepare title documents and appropriate registration wording.

Points to consider

Division cannot arbitrarily extinguish existing creditors’ rights. Check liabilities beforehand.
