Short answer

Property gifted to one spouse during marriage is generally that spouse’s separate property. Check who received the gift and whether later joint expenditure substantially increased its value.

Practical example

A parent gives an apartment only to their child. Marriage alone does not automatically give the other spouse half.

What to do

Find the gift deed, extract and later construction or alteration records. Establish whether the spouses agreed otherwise.

Points to consider

Disguising an actual purchase as a gift creates a further dispute. The transaction’s real substance must also be examined.
