Short answer

Inherited property generally belongs separately to the spouse who inherited it. The other spouse’s possible inheritance after their death is a different issue from dividing joint property on divorce.

Practical example

A wife inherits her mother’s apartment. Her husband’s potential inheritance after her death does not mean he owns half now.

What to do

Check the inheritance certificate, acquisition basis and substantial improvements funded jointly. Determine each asset’s status separately.

Points to consider

If a later transaction changed the spouses’ shares, the original inheritance is no longer the sole determining factor.
