Short answer

Property acquired during marriage is generally joint unless a marital agreement provides otherwise. One spouse’s lack of independent income does not itself exclude their rights.

Practical example

One spouse cares for the children while the other pays for an apartment from salary. Registration only in the payer’s name does not settle matrimonial ownership.

What to do

Establish marriage and acquisition dates, funding sources and agreements. Distinguish gifts, inheritances and premarital property.

Points to consider

Ownership status depends on the asset’s origin and agreements. Do not apply one conclusion indiscriminately to every asset.
