Where a gift conceals a paid transaction, the parties’ true intention and the concealed transaction’s mandatory requirements must be assessed. The document’s title is not decisive. But alleging a sale does not make every transfer evidence of its price.

Practical example

A buyer alleges a cash payment while the document records a gratuitous transfer. The payment’s purpose and the agreement’s substance need proof.

How to prepare

Keep transfers, receipts and negotiation correspondence. Do not alter the document yourself. Assess validity, tax consequences and any third-party rights already created.
