Short answer

Assignment is possible subject to conditions, but not every claim is transferable. The new creditor takes it in its existing state; assignment cannot arbitrarily increase the debt. Debtor protections and notice matter.

Practical example

A loan claim is assigned. That alone does not let the new creditor increase the amount or disregard valid defences.

What to do

Describe the claim and transferred documents. Check contractual restrictions, security and balance. The debtor should verify the new payee’s authority. Factoring and special relationships require assessment of additional rules.

Legal basis

Georgian Civil Code — Articles 198–202. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
