Short answer
The financial value of a company interest acquired during marriage may raise joint-property issues. Company-owned assets and a member’s ownership interest are not the same.
Practical example
A spouse owns an LLC interest while the LLC owns an apartment. The other spouse cannot simply redirect their claim to half the company’s apartment.
What to do
Obtain the acquisition date and price, articles, registry extract and business valuation. Assess division of the interest or compensation in practice.
Points to consider
Membership registration, transfers and constitutional restrictions also require business legislation. Family-law provisions alone are insufficient.
