Short answer

Changing ownership does not itself discharge an existing mortgage. The buyer may acquire property that can be sold to satisfy the creditor. The seller’s promise of later repayment is not a release.

Practical example

The buyer pays the seller in full, but the secured debt remains. The registered mortgage still exposes the new owner to risk.

What to do

Obtain a current extract and creditor-confirmed balance. Agree payment allocation, release documents and registration sequence in writing. Check other encumbrances and enforcement; do not rely on an oral promise.

Legal basis

Georgian Civil Code — Articles 286, 289, 295, 300, 301. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
