Short answer
This depends on creditor and debtor status and a lawful mortgage basis. The owner may differ from the borrower, but using a third party’s apartment does not bypass restrictions on loans to individuals.
Practical example
A parent is asked to mortgage an apartment for a child’s loan. This creates a real risk of losing property and differs from capped suretyship.
What to do
Review the entire loan, amount, interest, amendments and enforcement process. Check Article 286 exceptions. Address notice to the owner and potential claims against the debtor after repayment.
Legal basis
Georgian Civil Code — Articles 286, 289, 291, 292. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
