The donor’s death does not undo a completed gift. An heir’s dissatisfaction that the property is no longer in the estate is not itself a ground. Their legal interest, possible invalidity and special inheritance claims must be assessed.

Practical example

A forged-signature allegation differs from an argument that the deceased simply made a poor choice. Different evidence is needed.

How to prepare

Obtain the agreement, registry history and inheritance records; investigate the signature and expression of consent where necessary. Whether a personal claim passes to an heir needs separate analysis. Entitlement to a compulsory share may support a claim for supplementation taking the gift into account: this is not automatic revocation, and the ten-year exception must also be considered.
