A gift transfers ownership during life, with proper registration for immovable property. A will distributes the estate after death. The choice depends on whether the owner wishes to surrender control now and on the family’s interests.
Practical example
Leaving an apartment to a child later while retaining freedom to sell now differs from transferring it immediately, even with continued residence.
How to prepare
Compare retained use, the ability to make changes and compulsory shares. Check tax and inheritance consequences separately. After a gift, merely wanting the property back will generally not suffice.
