Short answer

As a general rule, an inheritance cannot be accepted partly, conditionally or for a fixed term. Ordinarily, you cannot accept an apartment but reject the deceased’s debts under the same inheritance entitlement. The Code provides specific exceptions.

Practical example

An heir wants the apartment while leaving the loans to another heir. That wish alone does not alter creditors’ rights.

What to do

List the assets and liabilities. Check whether you have separate entitlements on different grounds or a special exception applies.

Points to consider

An agreement distributing estate assets is different from partial acceptance. Its effects on creditors need separate assessment.
