Short answer
The general acceptance period is six months from the opening of the estate, normally the date of death. The rule on issuing a certificate after six months does not mean that the acceptance application should only be filed then.
Practical example
If a relative dies in January, waiting until six months have elapsed because ‘the certificate cannot yet be issued’ is risky.
What to do
Establish the exact opening date and apply on time. If obtaining property records takes longer, still discuss acceptance with the notary promptly.
Points to consider
Special cases and grounds for extending the period require separate assessment. Verify the calendar calculation with a lawyer.
