Short answer
If an heir dies after the estate opens but before acceptance, the acceptance right may pass to their heirs by hereditary transmission. This differs from dying before the original deceased.
Practical example
After his father dies, a son dies before accepting. The dates and whether acceptance occurred determine which rule applies.
What to do
Prepare both death certificates, the relationship chain and information about acceptance of the first estate. Check the remaining period: a special rule applies if less than three months remain.
Points to consider
If the first heir already accepted, the property may form part of that heir’s own estate, which is a different situation.
