Short answer

Refusal of proper performance or necessary cooperation may place the creditor in default. The debtor’s statement of readiness alone may be insufficient; the offer must match the obligation.

Practical example

A buyer is ready to pay but the seller withholds agreed bank details. Timely and proper tender must be established.

What to do

Send a clear offer and request cooperation. Keep evidence of available funds, notice and refusal. Assess deposit where appropriate; holding money in your own account is not performance.

Legal basis

Georgian Civil Code — Articles 390–393, 434. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
