Short answer
Tender must be specific, proper and compliant with the agreement. Establish amount, date, method and recipient response. Conditional or incomplete offers are not full performance.
Practical example
A debtor says payment will be made whenever they meet, without amount or date. A concrete offer is stronger evidence.
What to do
Use delivery-confirmed notices, banking records and agreed details. Retain reasons for a returned transfer. If the creditor delays acceptance, assess lawful deposit and notice.
Legal basis
Georgian Civil Code — Articles 361, 390, 391, 434, 438. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
