A defect does not always trigger automatic termination. Agreed quality, seriousness and the possibility of repair matter. The law provides repair, price reduction where appropriate and termination, each subject to its requirements.
Practical example
An old waterproofing problem appears in a recently purchased apartment. Establish whether it existed at handover or resulted from the buyer’s later renovation.
What to check
Document the defect with photographs and an expert opinion. Notify the seller in writing and allow time to repair where required. Preserve evidence before works; accepting a known defect may affect available claims.
