Short answer

First calculate what the person would inherit by law without a will. Their compulsory share is half that entitlement. Simply dividing an apartment’s value is often wrong: identify the estate and all heirs first.

Practical example

In a simplified case where the only heirs are two children and no other circumstances apply, each statutory share is one-half and the compulsory share one-quarter.

What to do

Calculate assets and liabilities, separate the spouse’s own property and obtain valuations. Investigate gifts.

Points to consider

The example is not universal: other first-ranking heirs, foreign law or an ownership dispute may change the result.
