Short answer
Ownership does not override the tenant’s lawful possession. Access for inspections and necessary work should be agreed beforehand, with notice where possible. Immediate danger requires separate assessment.
Practical example
The owner wants to show the apartment to a buyer. Having a key does not mean entry at any time has been agreed; arrange the visit with the tenant.
What to do
Set notice requirements, purposes and reasonable hours in the contract. Record unauthorised entry and demand in writing that it stop. In an emergency, retain evidence of the danger and the necessity of the measures taken.
Legal basis
Georgian Civil Code — Articles 540, 575. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
