Short answer
A will generally does not prevent disposal of property during the owner’s lifetime. Article 1402 governs the effect on a disposition of an asset already sold. An old will alone does not strip the buyer of ownership.
Practical example
The testator names a particular apartment, then sells it and buys another. The new apartment does not automatically replace the specifically named one.
What to do
Compare the exact wording with historical property extracts. Updating a will after property changes reduces uncertainty.
Points to consider
If the will covers the entire estate rather than a specific item, the assessment may differ.
