Short answer

Subletting normally requires the landlord’s consent. For residential premises, the law limits refusal where a valid reason and other conditions exist. Living with a family member is not automatically subletting.

Practical example

A tenant must move for work and wants to sublet part of the apartment. First check the contract and approach the owner with the proposed person and terms.

What to do

Obtain written consent specifying the term, people, liability and consequences of the main tenancy ending. Agree short-term platform rentals beforehand too. Another occupant’s arrival does not automatically release the original tenant.

Legal basis

Georgian Civil Code — Articles 549, 550, 551. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
