Short answer

A will may impose an obligation on an heir for another person’s benefit, including use of a home. Appointing an owner and granting use rights have different consequences.

Practical example

The child inherits the apartment, but the spouse is to live there for life. This intention must be expressed as a precisely defined legacy obligation.

What to do

Specify the home, duration, scope, expenses and beneficiary. Assess later registration and enforcement beforehand.

Points to consider

A lifetime use right is personal. It does not automatically pass to heirs or extend to family members.
