Short answer
A challenge needs a specific ground, such as a form defect, defective consent or another statutory circumstance. Leaving property to somebody else does not automatically invalidate a will.
Practical example
An heir alleges that the testator could not understand their actions when signing. Evidence from that period is required.
What to do
Obtain the will, relevant medical and other records, witness information and the death date. Article 1409 provides a special two-year period for an invalidity claim.
Points to consider
Claiming a compulsory share and challenging validity are different remedies. Confusing them complicates protection.
